Terms of Service

Effective September 2026

These terms govern every appointment booked with The Embry Group — general notarization, loan signings, mortgage and insurance inspections, and courier service — anywhere in Kentucky. Booking an appointment means you agree to them.

01  Scope of Services

The Embry Group provides commissioned notarial services, loan signing (NSA) services, mortgage field inspections, insurance inspections, and courier service, primarily within the Louisville / Jefferson County area and available by mobile appointment elsewhere in Kentucky. Current rates for every service are published in the Fee Schedule.

A quote generated through our online quote tool is an estimate based on the details you enter. It is confirmed as final when your appointment is booked, and again in writing before travel begins if anything about the job changes.

02  Not Legal Advice

I hold a Kentucky Notary Public commission. I am not an attorney licensed to practice law in the Commonwealth of Kentucky, and nothing I do or say in the course of a notarization, signing, or inspection is legal advice.

 

Notarial disclaimer. As a Notary Public, I cannot draft legal documents, select the type of notarial certificate you need, explain the legal effect of any document, or advise on how a document should be completed. My role is limited to verifying identity, witnessing signatures, and administering oaths or affirmations as required by Kentucky law. If you need help understanding a document or choosing the right form, please consult a licensed Kentucky attorney before your appointment.

03  Scheduling & Grace Period

Appointments are confirmed once a date, time, and location are agreed in writing (text, email, or the quote tool's confirmation). I build a 15-minute grace period into travel for every mobile appointment. If you need more than 15 minutes beyond the scheduled time, please let me know as soon as possible — a later arrival may push back the rest of that day's schedule or require rescheduling.

04  Cancellations & No-Shows

You may reschedule or cancel at no charge with at least 4 hours' notice before the scheduled appointment time.

With less than 4 hours' notice, or if I arrive for a mobile appointment and the signing cannot proceed for reasons outside my control — no one present, missing or invalid ID, an incomplete document package — the travel fee calculated for that appointment is due in full, since it reflects mileage and time already committed. The notarization or base service fee itself is not charged when an appointment doesn't go forward.

There is no separate cancellation deposit — the amount due is always the same travel figure the quote tool calculated when you booked, never a flat fee invented after the fact. A prepaid printing fee (see Payment Terms, below) is the one exception — it is non-refundable even if the appointment is canceled.

05  Payment Terms

Payment is due at the time service is completed, unless other arrangements were made in advance. I accept PayPal, Square, and Cash App, as well as cash. For loan signing assignments booked through a signing service or title company, payment terms follow the engagement agreed with that company at the time of assignment.

When an appointment requires me to print your documents, the printing fee is collected in advance and is non-refundable, including if the appointment is later canceled, rescheduled, or does not go forward for any reason.

06  Limitation of Liability

My total liability for any claim arising from a service is limited to the fee actually paid for that specific service. I am not liable for indirect, incidental, or consequential damages, for the legal sufficiency or accuracy of documents I did not draft, or for losses caused by a shipping carrier once a package has been tendered with tracking. This limitation does not apply to claims arising from fraud or intentional misconduct.

07  Client Responsibilities

Every signer must appear in person and present a valid, unexpired, government-issued photo ID that matches the name on the document. All parties to be notarized must be personally present at the same appointment. Please have your documents complete and ready — I can print pages on request for the fee listed in the Fee Schedule, but I do not draft, fill in, or correct document content.

08  Refusal of Service

Kentucky law requires a notary to decline to notarize when a signer cannot produce satisfactory ID, appears not to understand the document or the act of notarization, appears to be signing under duress or coercion, refuses a required oath or affirmation, or when I have a personal or financial interest in the transaction. If I must decline for one of these reasons, no notarial or service fee is charged; the travel fee still applies if travel to the appointment has already occurred.

09  Document Handling & Return Shipping

When a loan signing package must be returned by courier, return shipping is billed at the carrier's actual cost with no markup, and is the responsibility of the signing company or borrower unless a prepaid label is provided at booking. I am not responsible for delays once a package has been tendered to the carrier with tracking, and I keep no copies of your signed documents beyond what my notary journal requires by law.

10  Chargebacks & Disputes

If you have a concern about a charge, please contact me first — most issues are resolved quickly and directly. Filing a card chargeback for a service that was actually performed, without first reaching out, may result in the disputed amount being referred to collections and future appointments being declined. This does not affect your right to dispute a charge in good faith through your card issuer.

11  Force Majeure & Rescheduling

Severe weather, accident, illness, or other circumstances outside my control may require an appointment to be rescheduled. I'll make every reasonable effort to notify you as early as possible. When an appointment is simply moved rather than canceled outright, no additional travel charge applies to the rescheduled date.

12  Governing Law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any dispute arising from these terms or from a service performed under them will be brought exclusively in the state or federal courts located in Jefferson County, Kentucky.

13  Changes to These Terms

These terms and the Fee Schedule may be updated from time to time; the current version supersedes any prior copy. The version in effect at the time you book governs that appointment.

The Embry Group uses automated SMS text alerts for internal business operations — specifically, to notify me when a customer submits a booking request through my website's quote tool. These alerts are sent only to my own business phone number; customers and website visitors never receive text messages from me, only email confirmations.

Message frequency varies with booking activity — typically one message per booking request. Msg & data rates may apply. Reply STOP to cancel these alerts at any time, or reply HELP for assistance.
